Insurance adjusters often ask victims in personal injury accidents to sign a medical release authorization form. Often, the adjusters make the request as if it’s just business as usual and you’re required to comply. You have a right to decline this request, and you should. These forms are often so broad that they allow the insurance company to gather your private medical history regarding matters that have absolutely nothing to do with your accident. They’ll look for anything in those records to argue that your injuries were pre-existing and not the result of the accident. Talk to an attorney before signing any release that lets an insurance company comb through personal and confidential records that are unrelated to your accident.

The bottom line is that you need to be aware from the beginning of this process that you’re at an inherent disadvantage when you’re dealing with an insurance adjuster. The adjusters are generally sharp people who are given incentives to resolve claims cheaply and quickly. This doesn’t make them evil - they’re just doing their jobs protecting the interests of their employer.
